To explain why charges have not been filed against Hameer Ui Uddin for his role in the 1993 bombings of the Rajdhani Express and other trains, the Supreme Court has ordered Ajmer’s Special Judge Designated Court to submit a report to it. In addition, the division bench of Justices DY Chandrachud and MR Shah ordered the Special Judge to give a report within two weeks on the status of the TADA Special Case of 1994.
As a result, the Supreme Court further directed that a copy of its judgment be sent to the Special Judge, Designated Court, Ajmer, Rajasthan both directly and through the Registrar (Judicial) of the High Court of Rajasthan in order to speed up the report’s submission.
Uddin filed a Special Leave Petition on March 27 contesting the Special Judge in Ajmer’s denial of bail. Defending Hameer Ui Uddin, Advocate Shoeb Alam stated that Uddin was detained on March 18, 2010, but no charges had been filed against him and no trial was underway.
The state of Rajasthan stated in their counter-affidavit that the case was passed to the CBI on January 4, 1994, following initial investigation, and the CBI enrolled a FIR under Sections 5 and 6 of the Terrorist and Disruptive Activities (Prevention) Act 1987, Sections 4A, 4B, and 9B of the Explosives Act 1884, and Section 120B of the Indian Penal Code.
In addition, the State alleged that on August 25, 1994, the CBI had filed a charge sheet against the accused and that he had been absconding for 15 years.
Background
Several people were killed in a series of bomb attacks aboard Rajdhani express trains on December 5 and 6, 1993, according to the prosecution. Five cases were filed in Kota, Valsad, Kanpur, Allahabad, and Malka Giri police stations, and were then transferred to the CBI and re-registered under TADA. The inquiry discovered that all of the incidents were linked together as the result of a single conspiracy.
The CBI arrested Hameer Ui Uddin on August 25, 1994, after he had been missing for 15 years. According to the charge sheet, he was one of the defendants accused of transporting bomb devices and explosive material to Kanpur in December 1993.
As of March 18, 2010, Hameer Ui Uddin was arrested and charged under the TADA and Explosive Substance Act, the Prevention of Damages to Public Property Act, and the Indian Railway act. The 8000-page charge sheet was submitted against him.
