Bar Council Of India Seeks Withdrawal Of Strike By Delhi Bar Associations Over Judgment Convicting Rajiv Khosla


The Secretary of the Bar Council for Delhi, in a letter, addressed to the Chairman of the Bar Council of Delhi, has directed and requested the State Bar Council to forthwith direct and ensure that the Coordination Committee of All District Court Bar Associations of Delhi immediately withdraws the call for complete abstinence from judicial work by lawyers in District Courts across the State on November 9, 2021, as it is also to issue directions to them to withdraw the call.

On November 8, 2021, the Coordination Committee of All District Court Bar Associations of Delhi unanimously resolved to go on complete abstinence of work in the District Courts on November 9, 2021, in protest of the recent Tis Hazari Court judgement convicting former Delhi High Court Bar Association President Rajiv Khosla for assaulting woman lawyer Sujata Kohli in 1994, who had gone on to become a Dist.

According to the Hon’ble Chairman’s instructions, the secretary urges the legal fraternity that, “Being harbingers of the legal process, practise, and procedure, the lawyers fraternity is expected to do the needful not through strike and agitation but by way of providing legal assistance to Mr. Rajiv Khosla to file an appeal against the impugned order and judgement and to avail of all other legal remedies available under the law, as Mr Khosla is aggrieved

“Calling on all members of the Bar to abstain from judicial work in District Courts across the State for one day and then resolving to boycott the judicial officer indefinitely if the discussion with Hon’ble Chief Justice of Delhi does not go as per their desire will not go down well with the litigant public, the common masses, and the judiciary,” the secretary added.

Our profession is considered a noble profession, and the professional work rendered by us is unique and for the benefit of the common man, including aggrieved parties who come to Advocates in the hope that Advocates will be able to get them justice when all doors are closed for them

In reality, frequent strikes complicate matters and weaken the Advocates fraternity, as strikes are deemed illegal by the Hon’ble Supreme Court of India when it comes to Advocates, who are regarded as officers of the court and a component of the judicial machinery.
